Krka Banned from Selling Monkasta in Poland

Novo mesto/Warsaw, 28 January (STA) - Krka Polska has been banned from producing and selling a drug containing the active ingredient montelukast. Slovenian pharma Krka said its Polish subsidiary would challenge the temporary injunction issued by the Warsaw Business Court.

The procedure against Krka Polska was launched by American drug maker Merck. The decision was made without a trial (ex parte) and without searching a response from Krka Polska, the Slovenian parent company wrote on the website of the Ljubljana Stock Exchange on Wednesday.

The court ruled that Merck must file a lawsuit over the alleged patent infringement with the drug monkasta within two weeks, otherwise the injunction will become invalid.

Merck holds a patent for one of the procedures for production of motelukast, while Krka produces the ingredient by another procedure, which is "not in violation of Merck's patent in Poland", the company also wrote.

Krka started marketing the drug in Poland in January 2009.

Monkasta is used in the treatment of asthma.
